According to 33 CFR §151.10, which condition applies to a discharge of oily bilge water from a non-tanker vessel that is more than 12 nautical miles from the nearest land but is NOT proceeding enroute?
- A. The discharge is permitted provided the oil content is less than 15 ppm and the vessel is outside a special area
- ✓ The discharge must comply with the same conditions as if the vessel were within 12 nautical miles of the nearest landCorrect
- C. The discharge is prohibited under all circumstances when the vessel is not proceeding enroute
- D. The discharge is permitted at any oil content level provided the vessel is beyond 12 nautical miles
Why B is correct
33 CFR §151.10(d) states that when more than 12 nautical miles from the nearest land and not proceeding enroute, any discharge from a non-tanker or from machinery space bilges of a tanker shall comply with the conditions set out in paragraphs (b)(1) through (b)(5), which are the same conditions that apply within 12 nautical miles. The enroute requirement is one of the conditions in paragraph (a) that allows a less stringent standard; without it, the stricter within-12-mile conditions apply.
