§ 151.2080 § 151.2080 Penalties. (a) A person who violates this subpart is liable for a civil penalty not to exceed $35,000. Each day of a continuing violation constitutes a separate violation. A vessel operated in violation of the regulations is liable in rem for any civil penalty assessed under this subpart for that violation. (b) A person who knowingly violates the regulations of this subpart is guilty of a class C felony.

§ 83.01 § 83.01 Application (Rule 1). (a) These Rules apply to all vessels upon the inland waters of the United States, and to vessels of the United States on the Canadian waters of the Great Lakes to the extent that there is no conflict with Canadian law. (b)(i) These Rules constitute special rules made by an appropriate authority within the meaning of Rule 1(b) of the International Regulations for Preventing Collisions at Sea, 1972, including annexes currently in force for the United States (“International Regulations”). (ii) All vessels complying with the construction and equipment requirements of the International Regulations are considered to be in compliance with these Rules. (c) Nothing in these Rules shall interfere with the operation of any special rules made by the Secretary …

§ 83.02 § 83.02 Responsibility (Rule 2). (a) Nothing in these Rules shall exonerate any vessel, or the owner, master, or crew thereof, from the consequences of any neglect to comply with these Rules or of the neglect of any precaution which may be required by the ordinary practice of seamen, or by the special circumstances of the case. (b) In construing and complying with these Rules due regard shall be had to all dangers of navigation and collision and to any special circumstances, including the limitations of the vessels involved, which may make a departure from these Rules necessary to avoid immediate danger.

§ 83.03 § 83.03 General definitions (Rule 3). For the purpose of these Rules and Subchapter E, except where the context otherwise requires: (a) The wordincludes every description of water craft, including non-displacement craft, WIG craft and seaplanes, used or capable of being used as a means of transportation on water. (b) The termmeans any vessel propelled by machinery. (c) The termmeans any vessel under sail provided that propelling machinery, if fitted, is not being used.
